Search Volusia County Court Records

A Volusia County court records search starts with the Clerk of the Circuit Court, the local office that keeps case files for the courts that serve the county. Most people can look up Volusia County court records online, and the same office handles in-person and mailed requests. The records cover civil, family, probate, criminal, and traffic matters filed in the county. Many filings are open to the public, though some case types and documents are closed by law. Knowing which court holds a case, and what a search will show, makes it easier to find the right Volusia County court records the first time.

How to Search Volusia County Court Records

The safest starting point is the Clerk's Search Records page. It groups court case search, traffic citations, official records, jury inquiry, marriage documents, and arrest booking downloads in one place. For a specific case file, you want the Case Inquiry tool. The Clerk states that Case Inquiry covers Circuit Civil, County Civil, Family Law, Probate, and Criminal case records. You can search by a party name or by case number.

Before you start, gather what you know. A full name helps, and a case number helps more. Volusia case numbers usually combine a year, a sequence number, and a division code, such as "2026 103169 CFDB." Have the case type in mind too, since the Clerk's instructions point to a Case Type dropdown during a name search.

  1. Open the Clerk Search Records page and choose Case Inquiry.
  2. Accept the public-use disclaimer in the Case Management System. It states the site is for public informational use, is not the official record, and that certified copies may be purchased.
  3. Search by name or case number. For name searches, use the Case Type dropdown to narrow by Circuit Civil, County Civil, Family Law, Probate, or Criminal.
  4. Open a result to view the case detail and docket tabs. Some public document images appear automatically; others must be reviewed by the Clerk before release.
  5. Use Criminal Event or Civil Event inquiry instead when you want a court schedule by case type, official, or location rather than a full file.

The Clerk warns that scheduled maintenance runs Thursday nights between 7 p.m. and 9 p.m., so plan after-work searches around that window.

Types of Volusia County Court Records

The Clerk serves both the Circuit Court and the County Court, so the case types span a wide range. Felony criminal cases and larger civil disputes sit in Circuit Court. Misdemeanors, small claims, and traffic matters sit in County Court. Family law, probate, and guardianship are handled through Circuit Court divisions. Typical documents include the complaint or charging paper, summons, motions, orders, judgments, and disposition entries.

Which court produced a record affects where it lives and how it is labeled, but the Clerk is the local custodian for all of them. The main public categories are listed below.

  • Circuit civil: foreclosure, injunctions, declaratory actions, and larger or complex civil claims.
  • County civil: small claims, landlord-tenant, and lower-dollar debt disputes.
  • Criminal: felony and misdemeanor cases, with arrest, charge, plea, and sentencing entries.
  • Family law: dissolution, paternity, child support, custody, and injunctions for protection.
  • Probate and guardianship: estates, caveats, wills, trusts, and guardianship matters.
  • Traffic: non-criminal citation records searched through Citation Inquiry.

What Volusia County Court Records Show

A court record is more than a name and a number. Each case file holds the parties, the filing date, the docket of events, and the current status or disposition. Criminal files add charge counts, bond data, and sentencing. Financial fields can show filing fees, court costs, fines, and registry funds. The docket tab may carry public document images, but certified copies are purchased separately and are the version courts accept. The table maps the most common fields to what they tell you.

Public Access Laws for Volusia County Court Records

Florida starts from openness. Public access is a constitutional right under Article I, section 24 of the state constitution, and the public-records law lives in Chapter 119. Florida Statute 119.01 sets the policy that records are open, and Florida Statute 119.07 requires custodians to allow inspection and copying at reasonable times, redact exempt parts, and provide copies once lawful fees are paid.

Court files have an extra layer. Florida Statute 119.0714 covers exemptions for court files and court records, and Florida Rule of General Practice and Judicial Administration 2.420 governs access to judicial branch records and lists the confidential categories. Together these rules drive what the Clerk can display online. Anyone may search and request, and the Clerk performs name searches for $2 per name per year when staff do the work.

Records That Are Sealed or Confidential in Volusia County

Some Volusia County court records are closed by statute, rule, or court order. Juvenile delinquency and dependency records are restricted under Florida Statutes 985.04 and 39.0132. Adoption records are confidential under Florida Statute 63.162. Mental health clinical records carry protection under Florida Statute 394.4615. Sealed and expunged criminal records are restricted after a court order under Florida Statutes 943.0585 and 943.059.

If a case or document that should exist does not appear, it may be sealed, confidential, not yet indexed, or simply searched the wrong way. The Clerk can confirm how access works but cannot disclose sealed contents. Viewing a closed record may require party or attorney status, elevated access under court rules, or a court order. See the criminal records page for the seal and expunge process.
