About the Volusia County Clerk of the Circuit Court
Laura E. Roth serves as Clerk of the Circuit Court for Volusia County. The Clerk is an elected constitutional officer under the Florida Constitution. That means the office answers directly to county voters, not to a judge or a county commission. The position carries both court-side duties and recorder duties, which is a combination that sets the Florida Clerk apart from many other states. The Clerk's own published description says the office handles property transactions, court proceedings, official court records, public access as the law permits, domestic abuse assistance, child support payments, court fees and fines, court-ordered sales, and marriage applications.
Because the Clerk serves both the Circuit Court and the County Court, the types of cases on file span a wide range. Felony criminal cases, family law matters, civil disputes, probate and guardianship, and traffic cases all land with the Clerk. The official recording function adds deeds, mortgages, easements, liens, plats, powers of attorney, military discharges, and judgment recordings to the mix. That dual role as court clerk and recorder is the reason why court cases, marriage records, deeds, and probate-related recordings all point to the same agency at clerk.org.
The Clerk contact page at clerk.org is the authoritative source for current hours, routing, and department details. Room assignments and phone extensions should be confirmed before traveling, since the office operates across three Volusia County locations.

Clerk Departments and Volusia County Locations
The Clerk runs separate departments for each major case type. Each department has its own phone number and, in some locations, its own room. A user filing a family law motion, requesting a marriage license, researching old deeds, and attending jury service may each need a different building. The DeLand courthouse is the main hub for Official Records research and general Clerk services. The Henderson Judicial Center in Daytona handles most east-side civil, family, and county court functions. The Foxman Justice Center is where felony criminal filings and jury service are processed.
The Clerk's departments page lists each division with its scope of services.
Volusia County Clerk Departments Online
The Clerk's contact page at clerk.org is the primary routing guide for anyone visiting or calling a Volusia County Clerk office. It publishes office addresses, room numbers, phone numbers, and parking details for all three locations.
The contact page covers all three Clerk locations and lists each department with its room number and phone, which helps visitors plan before they travel to any Volusia County courthouse.
The Clerk departments page gives a broader overview of each division and the services it handles for Volusia County residents.
Each department listed there links out to more detail, including forms, fees, and division-specific instructions for things like marriage licenses, probate filings, and official recording.
Online Records Search Through the Volusia County Clerk
The Clerk's Search Records page is the central portal for public records inquiries. It links to Case Inquiry, Citation Inquiry, Official Records document inquiry, event inquiry tools, jury inquiry, marriage documents, and the arrest booking download. Most public searches start here. Case Inquiry covers Circuit Civil, County Civil, Family Law, Probate, and Criminal case records. You can search by party name or by case number.
The online system is informational only. The Clerk is clear that only records kept in the office are official. For any legal proceeding, certified copies must be purchased. Some case types and some documents within a case are nonpublic by statute, rule, or court order and will not appear in online results. If a case file does not appear, it may be confidential, not yet indexed, or the name may have been entered with a different spelling.
Official Records are available online for recorded instruments dating from April 4, 1988, to the present. For earlier records going back to 1887, the Clerk maintains a public research area in the Recording Department at Room A121 in the DeLand courthouse, with terminals for both microfilm and digital images. Access there is free of charge during office hours.
The Clerk schedules online system maintenance on Thursday nights between 7 p.m. and 9 p.m. Plan searches around that window if you work after hours. Other maintenance windows may be posted in the Clerk's public notices section.
Users who need elevated viewing access beyond standard public inquiry may apply under Florida Supreme Court Administrative Order AOSC 16-14. That process requires a notarized application with user and category information submitted to the Clerk. Most searches do not require this level of access.
Note: Daily civil and county suits reports remain online for about 30 calendar days, and the criminal arrest download covers approximately 14 calendar days of bookings.
How to Request a Volusia County Clerk Certified Copy
Certified copies carry the official Clerk seal and signature. Courts, lenders, government agencies, and other legal proceedings typically require a certified copy rather than an online printout. A certified copy costs $1 per page plus a $2 certification fee. An exemplified certificate, which adds a second judicial authentication above standard certification, costs $7. The steps below apply to most certified copy requests through the Volusia County Clerk of the Circuit Court.
- Identify the case number or document details. For court records, the case number (such as "2026 103169 CFDB") speeds up the search. For Official Records instruments, the book and page number or recording instrument number works best. If you don't have a case number, the Clerk can perform a name search for $2 per name per year.
- Choose how to submit your request: in person at the DeLand courthouse or the appropriate Daytona Beach counter, by mail, or through the Clerk's online contact form at clerk.org. For marriage records by mail, address the request to the Clerk, Attention: Marriage Department, and include both parties' names, the date of marriage, the fee, and a self-addressed stamped envelope.
- Calculate and include the correct fee. Standard copies are $1 per page. Certification adds $2. Exemplified certification adds $7. Seal or expunge filings carry a separate $42 fee before the case is processed. Credit card payments carry a 3.5% nonrefundable processing fee from the financial service provider.
- Submit the request. In-person requests are handled at the counter in the relevant department. Mail requests go to P.O. Box 6043, DeLand, FL 32721-6043 (or the marriage department at that address). Online requests can be started through the Clerk's contact page.
- Receive the certified copy. In-person requests may be completed the same visit depending on the department's workload. Mailed requests include return postage if you include a self-addressed stamped envelope. The Clerk will contact you if additional fees are owed before release.
The Clerk cannot perform title searches or lien searches. Staff can provide copies of recorded documents, but interpreting what the records mean for a property transaction is outside what the office does. For that, consult a title company or attorney.
Volusia County Clerk Records Request Form Fields
Different request types use different forms. The Clerk's forms page is the best starting point. For criminal traffic copy requests, the form asks for case identification, the type of copies or search needed, payment, and requester contact or mailing details. For seal and expunge requests, the packet has more fields because a court order is involved. The table below covers the main fields the Clerk asks for across common request types.
| Field / Item | Required | Notes |
|---|---|---|
| Case number | Preferred | Year + sequence + division code, e.g. "2026 103169 CFDB." Name search available for $2 per name per year if case number is unknown. |
| Party names | Yes if no case number | First and last name of petitioner, respondent, plaintiff, or defendant. For marriage records by mail, names of both parties are required. |
| Date of event | For marriage and older records | Year of marriage or approximate filing year narrows the search. Older records may require a search fee if staff must locate them manually. |
| Document type or record requested | Yes | Specify the document or type: court case copy, Official Records instrument, marriage certificate, seal/expunge packet, etc. |
| Number of copies | Yes | Fee is per page; specify how many copies to calculate the correct payment. |
| Certification needed | Specify | Plain copy is $1 per page; certified copy adds $2; exemplified certificate adds $7 total over plain copy cost. |
| Requester contact and mailing information | Yes for mail requests | Return address and self-addressed stamped envelope required for mail requests. Phone or email helps the Clerk reach you if the order needs clarification. |
| Payment | Yes | Cash, check, money order, or card (card adds 3.5% processing fee). Seal/expunge requests require the $42 fee before processing begins. |
| FDLE Certificate of Eligibility (seal/expunge only) | Yes for seal or expunge | Must be attached. Also requires a sworn statement and a proposed order to seal or expunge. |
For Official Records requests, the Clerk accepts instrument number, book and page, or name search. The eRecording option lets submitters scan and upload documents through vendor applications. Prices vary by vendor and the service is often used for Notice of Commencement and lien-related filings.
Volusia County Clerk Fee Schedule
Florida statute sets most of the fees the Clerk charges. The amounts below come from the Volusia County Clerk's published fees and fines page. Fees apply to copies, certifications, searches, marriage licenses, and specific request types. There are no fees for simply searching online through the Clerk's public portal, but in-person or staff-assisted searches carry a charge.
| Item | Fee |
|---|---|
| Records search (staff-assisted), per name per year | $2.00 |
| Copy, standard page (8.5 x 11 or public record) | $1.00 per page |
| Official Records copy per page | $1.00 per page |
| Certification of copy | $2.00 |
| Exemplified certificate | $7.00 |
| Certified marriage copy (additional copy) | $3.00 |
| Marriage license application | $86.00 |
| Marriage license with premarital course | $61.00 |
| Wedding ceremony performed by Clerk | $30.00 |
| Seal or expunge any court record (filing fee) | $42.00 |
| Payment plan administrative fee | $25.00 |
| Credit card processing fee | 3.5% (nonrefundable) |
Public records assistance fees may vary depending on the complexity and volume of a request. The Clerk's fees and fines page at clerk.org is the authoritative source and should be checked before submitting any payment, since fees are set by statute and subject to change by the Florida Legislature.
Note: The $42 seal or expunge filing fee must be paid before the Clerk will process the petition; copy and certification fees apply separately if you need copies of the resulting order.
Official Records and Recording in Volusia County
The Clerk's recording function is why property documents, court judgments, and vital records all end up in the same place as case files. Under Florida law, the Clerk acts as county recorder and maintains the Official Records of Volusia County. Instruments recorded include deeds, mortgages, easements, liens, plats, powers of attorney, military discharges, marriage records, probate-related documents, and judgments. The recording function does not mean the Clerk verifies the accuracy or legal effect of a document. Staff record what is submitted according to statutory requirements.
Online access to Official Records runs from April 4, 1988, to the present through the Official Records inquiry portal. You can search by name using an alphabetical index, by instrument number, or by book and page. Advanced search options allow filtering by document type and date range. Records that have been indexed, verified, and released for public viewing appear in results. Not every recorded document is immediately available online; the Clerk releases images as they complete the indexing and verification process.
For records older than 1988, the public research area in Room A121 at the DeLand courthouse gives access to instruments going back to 1887 on microfilm and digital images. Staff are available to assist but cannot conduct title searches or interpret what the records mean. The Recording Department phone is (386) 736-5912.
There are four ways to submit a document for recording. In person at the DeLand Recording counter or the Daytona Henderson counter is the most direct. By mail to the P.O. Box 6043 address works for many document types. eRecording through a vendor application lets submitters scan and upload remotely. Credit card payments for recording transactions carry the same 3.5% nonrefundable processing fee.
